MyCrowd Enterprises, Inc. Design Submission Legal Terms & Conditions

MyCrowd Enterprises, Inc. (hereinafter referred to as “MyCrowd”) retains exclusive rights to the submitted design, if chosen, for printing, reproducing, or selling. Additionally, MyCrowd retains rights to the design itself for use on MyCrowd’s web site and any promotional materials utilized by MyCrowd.

The participant will keep ownership of the submitted design. The participant may display or archive the design in a portfolio or personal collection, however, the participant shall not sell or reproduce the design for commercial purposes for a period of one hundred eighty (180) days commencing on the date the MyCrowd completes the scoring of the design. Additionally, during the one hundred eighty (180) period, the participant shall not submit the design to another company or entity for the purposes of producing or reproducing the design or clothing with the design affixed thereto. Upon the expiration of the one hundred eighty (180) day period and if the design was not chosen for print by MyCrowd, the participant is free to use the design for commercial purposes, however the participant must contact MyCrowd in writing via email or regular mail to notify MyCrowd where and when the design will be produced so that the design can be removed from MyCrowd’s web site. Also, if the design is printed by any company or entity, other than MyCrowd, the participant cannot use MyCrowd’s blogs to promote the product or another company.

The designs must be the participant’s own original work and may not have been previously published. The submitted designs shall not contain the trademarks, logos, copyrighted works or intellectual property of any third parties, or any material, which MyCrowd in its sole discretion deems to be profane or offensive. The participant agrees to indemnify and hold MyCrowd harmless against all losses, claims, liabilities and expenses, including reasonable attorneys fees, arising out of the submission of a design that contains a trademark, logo, copyrighted work or intellectual property belonging to a third party.

If your design is selected by MyCrowd, MyCrowd reserves the right to rework or alter the design to prepare the design for use. As a result, there may be slight changes in the color or size of the design.

Participants who, in the opinion of MyCrowd, do not comply with the aforementioned terms and conditions can, at any time, be excluded from consideration for whatever reason and without notice or explanation.

All decisions made by MyCrowd are final and binding.

The participants who submit the best designs, as selected or determined by MyCrowd, after a vote and rating review, will win $200.00 and $1.00 per shirt sold using their design. Payments will be made at the end of each month. Participant must provide necessary information for IRS reporting prior to payment.

Additionally, if the design meets the criteria of the copyright laws of the United States, MyCrowd may register the design with the U.S. Copyright Office. This registration will list the participant/designer as the primary copyright owner with MyCrowd being listed as an additional copyright claimant. A copy of the registration certificate will be forwarded to the participant upon receiving it.

MyCrowd Enterprises, Inc. (hereinafter referred to as “MyCrowd”) retains exclusive rights to the submitted phrase for printing. Additionally, MyCrowd retains the phrase for use on MyCrowd’s web site, and any promotional material utilized by MyCrowd.

The phrase must be the participant’s own original work and may not have been previously published. The phrase may not contain the trademarks, logos, copyrighted works or intellectual property of any third parties, or any material, which MyCrowd, in its sole discretion, deems to be profane or offensive. The participant agrees to indemnify and hold MyCrowd harmless against all losses, claims, liabilities and expenses, including reasonable attorneys fees, arising out of the submission of a phrase that contains a trademark, logo, copyrighted work or intellectual property belonging to a third party.

If your phrase is selected, MyCrowd reserves the right to rework the phrase to prepare it for use. As a result, there may be small word changes or additions to the phrase.

Participants who, in the opinion of MyCrowd, do not comply with these guidelines can, at any time, be excluded from the running without notification or explanation.

The decisions of MyCrowd are final and binding.
